4.4 Refund Policy

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHATAPATA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business
- Loss of data or data breach
- Business interruption
- Loss of goodwill or reputation
- Cost of substitute services
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Khatapata and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will immediately cease.
12.2 Termination by Us
We may suspend or terminate your account and access to the Service at any time, with or without cause, including if we reasonably believe:
- You have violated these Terms
- Your use poses a security risk
- Your use may cause legal liability
- Your account has been inactive for an extended period
12.3 Effect of Termination
Upon termination:
- Your license to use the Service ends immediately
- We may delete your account and User Content
- Provisions that should survive termination will remain in effect
- You remain liable for any obligations incurred before termination
13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of Nepal.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Khatapata regarding the Service.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
